Terms and Conditions of Sale — Sant Roch (Contrast Vendôme)

This English translation is provided for information purposes only. In the event of any discrepancy, the French version shall prevail.

Preliminary Article: Definitions

Membership: a contract providing access to the services at preferential rates, in exchange for a monthly payment (subject to the specific conditions).

Activities: wellness and hot/cold ritual sessions led by a Sant Roch guide/coach, including, depending on the session, sauna, cold plunges, breathing exercises, meditation and/or mobility work, practiced in groups within the establishments. These activities constitute neither a medical act nor a form of therapy.

Sant Roch: a brand of Contrast Holding, SAS, 8 Rue Saint-Roch, 75001 Paris.

Member / Subscriber: any person who has taken out a Membership or purchased credits / a Pack. Purchase constitutes acceptance of these Terms and Conditions as of the date of purchase.

Studio(s): dedicated spaces operated by Sant Roch.

Terms and Conditions of Sale (T&Cs): these provisions governing the relationship between Sant Roch and its Members.

Block: a sequence of one or more back-to-back sessions.

Article 1 – Purpose

These T&Cs constitute the sole legal framework between the Member and Sant Roch, to the exclusion of any other document. They apply to all Members.

Article 2 – Registration and Access

Acquiring an entitlement

Purchase of credits (a “Pack”) or subscription to a Membership. The holder becomes a Member for the validity period of the entitlement. Purchase constitutes acceptance of the T&Cs.

Registering for a session

Prior registration online or on site. Capacity is limited (see Article 17 – Maximum occupancy). Payment of the entitlement is required before booking. The Member is responsible for their bookings (location, date, time, number of spots). Cancellation / modification: no later than 24 hours before the start of the session; otherwise the session is deducted and/or penalties apply.

Article 3 – Applicable T&Cs

The T&Cs may be updated without prior notice. The applicable T&Cs are those in force on the date of purchase (credits, Pack, or Membership). The applicable house rules are those in force on the day of the session.

Article 4 – Services, Duration, Extension, Termination

4.1 General conditions

The entitlement (credits / Pack / Membership) grants access to sessions; this right is non-transferable. In-store purchases are non-refundable. Online purchases benefit from the right of withdrawal (French “Hamon” law). Cancellation / modification: at least 24 hours before the session; otherwise the session is deducted and/or penalties apply. Prices are specified in the specific conditions. Memberships are billed by monthly direct debit. The Member certifies their medical fitness and agrees to comply with hygiene and safety instructions. Sant Roch recommends that participants provide a medical certificate. Memberships are non-transferable.

4.2 Duration

After the commitment period: tacit renewal on a full-month basis, cancellable at any time upon request to customer service. Promotions and new offers have their own specific durations.

Duration and extension

Unused credits within their validity period are not refunded. An extension is possible in the event of a closure of the center (excluding summer and Christmas holiday periods). An extension is also possible upon presentation of a medical certificate of unfitness of more than one month, to be requested before the end of the validity period.

4.3 Payment default

In the event of payment default, access is suspended and the file is referred for contentious debt recovery (in accordance with French Law 78-17). Termination occurs automatically 15 days after a formal notice has remained without effect. All amounts due through the end of the term become immediately payable, plus a penalty of 10% of the outstanding amounts.

4.4 Termination by the Member

4.4.1 Without cause (outside the commitment period)

15 business days' notice before the next due date. For a 3-month commitment: no reduction applied.

4.4.2 For legitimate reasons (at any time)

The following are accepted as legitimate reasons, upon presentation of supporting documents: serious illness, serious accident, death, redundancy on economic grounds, professional transfer or relocation to more than 25 km from a studio, pregnancy. A suspension is possible during the interruption period and extends the commitment period accordingly. Excluded: conditions predating registration, spa treatments, and cosmetic, psychological, or psychotherapeutic care. Any cancellation made less than 12 hours before the start of the session, or any no-show without prior cancellation, may result in a penalty of €15 including tax.

4.4.3 Suspension at the Member's initiative

Outside the commitment period: up to 2 suspensions per year, each lasting a maximum of 2 months. With a medical certificate (unfitness of more than one month): suspension and extension of the commitment for an equivalent duration.

Article 5 – Prices and Payment

Prices are displayed on the website and at the entrance to the studios; they are subject to change. The applicable prices are those in force on the day of subscription or purchase. Payment is made by bank transfer or automatic direct debit (bank details, proof of identity, and SEPA mandate required). Memberships are debited monthly. In the event of a payment incident, the amount due is increased by the corresponding bank fees; repeated incidents result in termination and the immediate payability of all amounts due.

Article 6 – House Rules (Excerpts)

The following are prohibited: any violent or inappropriate behavior; sexist, racist, or religious remarks; consuming food or alcohol outside the dedicated areas; running or diving; unannounced breath-holding; and the use of electrical devices near the pools.

Access is reserved for Members holding a valid entitlement and registered for the session. Appropriate attire is mandatory (a swimsuit for water-based activities). A soap shower is required before entering the pools. Any incident must be reported; safety instructions must be followed at all times. Non-swimmers must inform the staff. Use of the locker rooms is mandatory; they are separated by sex and must be left clean.

Article 7 – Payment by Card

Payment is made online and debited upon validation. Transactions are secured by STRIPE (Visa, Mastercard, and domestic cards). Sant Roch has no access to card numbers.

Article 8 – Insurance

Sant Roch does not supervise personal belongings that are not stored in a locked locker. Taking out individual accident insurance is recommended (optional).

Article 8 bis – Physical Fitness and Liability

Before any participation, each Member declares that they have had their fitness for the proposed activities (exposure to heat and cold, breathing exercises, relaxation, etc.) checked by a physician.

Sant Roch declines all liability in the event of an accident, discomfort, or bodily injury occurring during or following a session if the Member has not undergone this prior medical check, or if they fail to comply with the safety, hydration, and recovery instructions communicated by Studio staff.

By taking part in an activity, the Member acknowledges that they do so under their own responsibility, that they are in good physical condition, and that they have no known medical contraindication to hot/cold practice or breathing exercises.

In accordance with Article L321-4 of the French Sports Code, Sant Roch recommends that all participants take out individual accident insurance covering bodily injury that may occur during sessions.

Article 9 – Irrevocability and Right of Withdrawal

The purchase of credits or a Membership constitutes acceptance of the T&Cs. For distance purchases, a withdrawal period of 14 full days applies (Articles L121-19 et seq. of the French Consumer Code). This provision does not apply to legal entities. Credits and Memberships are personal and non-transferable.

Article 10 – Disputes

These T&Cs are governed by French law. In the event of a dispute, the matter will be brought before the competent courts, with the consumer having the option of choosing the court of their place of residence at the time the contract was concluded or the harmful event occurred.

Article 11 – Consumer Mediation (AME – FEVAD)

In the event of a dispute, a prior complaint must first be addressed to customer service. Failing resolution, the Member may refer the matter to the AME mediator within one year:

Article 12 – Other Provisions

These T&Cs constitute the entire agreement between the parties and supersede any prior agreement. The invalidity of any one clause does not affect the validity of the remaining provisions.

Article 13 – Termination and Force Majeure

Fixed-term credits cannot be cancelled. Sant Roch cannot be held liable for events beyond its control. If the center is closed for more than 2 months, termination is possible by registered letter with acknowledgment of receipt, taking effect within 15 days, with a refund of sessions paid for but not attended. If a session is cancelled (due to lack of staff or fewer than 5 participants), the validity period of the entitlement is extended by one week. The conditions for terminating a Membership are set out in Article 4.4.1.

Article 14 – Safety and Liability

The Member declares that they are fit for physical activity. Personal belongings remain the Member's responsibility; use of a locker is recommended. Members remain liable for any accidents they cause.

Article 15 – Personal Data

Personal data is used to manage the Membership or Pack. Emails may be sent to the Member, who has the right to object. The Member also has the right to access and rectify their data.

Article 16 – Loaned Items and Returns

Loaned towels must be returned after the session; failure to do so may result in legal action. In-store purchases may be returned for a refund within 7 days, provided the items are in their original condition (tags intact). Sauna hats and sauna shoes can be neither returned nor exchanged.

Article 17 – Miscellaneous

Video surveillance

The studios are under video surveillance 24 hours a day, 7 days a week.

Maximum occupancy

Maximum capacity is 199 people.

Access hours

Access follows the schedules published on the websites. The center opens 15 minutes before the first session of a block and closes 20 minutes after the last. We recommend arriving 10 minutes before the start of your session. In case of lateness, access may be refused and the session deducted, with penalties applied. Access outside scheduled time slots is prohibited, except by special authorization.

Reminders

Damaging the facilities is prohibited (repair costs are borne by the offender). Legal action may be taken in the event of damage. Towels and mitts must be placed in the dedicated bins when leaving the session. Emergency exits are reserved for emergency situations only.
